The leaves of the kratom tree are eaten worldwide for their supposed inspiring and refreshing effects. The kratom tree, scientifically called Mitragyna speciosa, grows in the tropical jungles of Southeast Asia. It belongs to the Rubiaceae family of plants.

Here in the U.S., kratom is legal at a federal level. The Drug Enforcement Agency almost banned kratom in 2016, only reversing course after receiving public backlash. The use of kratom in the United States was relatively new at the time. There were fears about the plant, fears which stemmed from a relative lack of awareness. Kratom’s explosion in popularity led to several countries, including some US states, banning kratom.

If you live in one of the few states that have outlawed or restricted kratom, the state ban overrides the federal legality. This guide will tell you all you need to know about kratom’s legal status in Oregon.

Is Kratom Legal in Oregon?

Kratom is legal in Oregon. It should come as no surprise for the state that has decriminalized all drugs.

Before decriminalizing all drugs in 2020, the Oregon Legislative Assembly looked at bills regarding banning or regulating kratom. None of them succeeded in passing. Therefore, kratom was never outlawed.

History of Kratom Legislation in Oregon

The earliest legislative record about kratom in Oregon is Senate Bill 518 in 2017. SB518 would have declared a state of emergency to direct funds to the Oregon State Board of Pharmacy to study kratom. The Legislative Assembly wanted recommendations on classifying it as a Schedule I controlled substance. The bill failed to pass in the committee.

In 2019, Senate Bill 1005 included language to regulate the sale of kratom. The bill wanted to prohibit its sale to minors, require vendors to register with the Department of Agriculture, and make strict labeling requirements to ensure refined products. This language was struck from the bill.

In 2020, HB4013 was another bill intended to regulate kratom sales. This version of the Kratom Consumer Protection Act passed the House unanimously. It died in the Senate, though, and kratom is as of yet unregulated in Oregon.

Buying Kratom in Oregon

Since kratom is unregulated in Oregon, your safest option is to purchase it online. Online kratom vendors tend to follow labeling practices and verification statutes from the states with the strictest regulations. They also specialize in kratom, meaning they have a deep understanding of the market. By knowing where to buy from, online vendors sell high-quality kratom at the most competitive prices.

There are also brick-and-mortar kratom vendors in Oregon. Typically they do not have the same specific knowledge as online retailers, so you might need to shop around to find a kratom store that suits you. By buying locally, you can be sure your money stays within the Oregon economy, where it will help sustain jobs for the local community. You also get the added convenience of enjoying your product on the day you buy it.
